when macaulay comes to town to hand out EDITED no viable information, jessee jones and king tv 5 cameras should be in the room.
what would happen if everyone in os refused to pay up? would macaulay then own the town and put padlocks on everyones door?
It’s really too bad that all this time and effort was not spent PRIOR to the LID being passed. If it were, we would not be in the mess we are in now. Just like the other issues that were dealt with after the fact, the only ones that are going to come out ahead are the lawyers. The rest of us will end up paying even more than we owe now. The longer this drags on, the more it will eventually cost us. History does, indeed, repeat itself.
An assessor will consider the condition of the roof of a home. If it is 20 years old and needs replacing, he will note it and reduce the value of the home when he compares it to a similar home with a new roof. The federal government considers a new roof repairs and not improvement. However that is a tax basis issue. This is a market value question. So, the roads being improved do improve the value of the home. The question really is how much? That all depends on what the roads were like before and after. That is why the study used the old road condition report and then the new roads condition and what was used to improve it.
Either way, we get to pay.
My neighbor made a good point in a conversation I had with him today. He said that what was done to the roads was simply maintenance of an existing road system whose impact on property values has already been included in the assessed value of a home and that this maintenance should not have any influence on the value of a property. He likened it to replacing a roof: if you replace a roof with the same material (composition with composition) it will not affect the value of the home, but if you replace it with a better grade of material (composition with tile) it will. If this is the case, then the cost of fixing the roads should be equally divided among all 12,000 lots and not based on some convoluted formula.
The special benefit is calculated between the value of the land only, before and after the LID work. Notice on the chart that the improvement values stay constant before and after the LID road work, totally proving this premise. This was information you didn’t have until now.
In order to have a legitimate appeal, you have to have an appraisal after the road was over, indicating that the appraisal was lower than Macaulay’s “after LID” appraisal to dispute the special benefit. The case law found on the MRSC website specifies “immediately before and after”, which may require some interpretation. I am using Macaulay’s values and the county assessor’s 2007 values for my “before” numbers and I have an appraisal after the road work was done for my “after” value.
Remember that if you have had a loan refinance or purchase after the road work was done, that this should have an appraisal with it, and you may have to contact your lien holder for it, if you don’t have a copy. Good luck-see you at the hearing.

Must be some setting there as I shifted over to Firefox and they showed up. I use Adobe reader all the time and this is the first time I’ve had a problem with it.
It worked fine for me and I was using Mozilla. Wish I could figure out how the value of the land was derived. I don’t really agree with the valuation of the land. But I guess it didn’t take into consideration the nose dive the price of lots has taken this past year. The value was based on when the paving was finished. Do I have it right?
Are you using IE8? Have you checked your settings there?
Worked for me. I just hit the disk icon and it came in just fine. Check your virus software. You may have it set to block certain types of files.
